Information for MUSD School Sites on Handling Claims

"Any person who, with intent to defraud, presents to any School District any false or fraudulent claim, is guilty of a felony punishable by fine and / or imprisonment."

(California Penal Code, Section 72, Refers)

Claim Requirements

A government tort claim must be filed against a public entity for any monetary claims for personal injury or death, or for damages to personal property or crops, California Government Code, Section 911.2 refers.  Public entities are now required to provide claim forms when requested.  California Government Code, Section 910.4 refers.

Exemptions

California Government Code, Section 905, exempts many non-tort claims from the claim filing requirements where adequate claims procedures already exist:

  • Tax Refund Claims
  • Salary Claims
  • Unemployment Insurance Claims
  • Bond Claims
  • Claims for Inverse Condemnation

Other claims are exempted by case law:  Federal Civil Rights Claims and FEHA Claims.

Time Limits for Filing Claims

  • Six months from the accrual of a cause of action for personal injury, death or property damage.  This is typically the date of loss.  However, some actions only accrue when the injury is discovered.
  • One year for minors.
  • One year for breach of contract.

Reporting a Claim

Click on this link to download a claim form, print the form and provide the form to claimant.  Within the time constraints listed above, the claimant must  fill out the form in its entirety attaching any supporting documentation as necessary to support the claim, sign the form and mail or fax the Property & Liability Claim Form to:

Notification by School Site

If an incident of personal injury or personal property damage occurs on your school site, regardless of issues related to fault, please contact the Director of Risk Management immediately at (951) 672-1851. Do not wait for the claim form to be processed.
